IVE Law 21,030, Voluntary Termination of Pregnancy in Three Cases

In this section we provide the essential material about the law 21,030, which was promulgated in September of 2017 after a two year long discussion. This law regulates the depenalization of the voluntary termination of pregnancy in three cases. Before this law, abortion was illegal and criminalized under all circumstances. This represents a severe violation of human rights. The law 21,030 modifies the Penal Code and the Sanitary Code to guarantee the access to the termination of the pregnancy when the life of the woman is at risk, when the fetus has no chance of surviving outside the uterus or when the pregnancy is the result of rape. It is important to clarify that this law seeks not only to depenalize abortion but to widen the access to health care for women, as this health service has to be offered by health professionals for free at public establishments. In addition to this, the law comprehends a biopsychosocial support service intending to make the decision of continuing or not with the pregnancy easier. The law allows personal and institutional conscientious objection.
